Drug Investigation at Matthew’s Market ‘Ongoing and Open’

West U police are still investigating a year-old allegation of drugs being sold at Matthew’s Market.

The City of West U is seeking an Attorney General’s decision to withhold information requested by InstantNewsWestU.com in an open records request about the case.

According to a letter to the Attorney General from a West U city attorney, the city is asking to “withhold the requested information not considered to be basic information from release.”

“The city maintains that the submitted information relates to an ongoing and open investigation and that the release of any information other than the basic information will interfere with the detection, investigation, or prosecution of crime. Therefore, the city requests that it be permitted to withhold all information other than the basic information responsive to the request,” City Attorney Elliot Barner said in his letter.

Barner is an attorney with Johnson, Radcliffe, Petrov and Bobbitt PLLC, the firm that represents the City of West U.

InstantNewsWestU.com first published a story about the report of drugs being sold outside Matthew’s Market on June 8, 2011.

The story referenced a letter that was widely circulated in the West U area, which said that “Lamar kids” were reportedly tying to sell drugs to younger children around Matthew’s Market.

The e-mail went on to warn parents about the situation and to remind their children to be careful.

In June 2011, Police Chief Ken Walker confirmed that the police department was aware of the situation and was “looking into it.”

InstantNewsWestU.com filed an open records request on Nov. 16 for all documents related to the case.

The police department released an incident report and the following narrative on Nov. 21 and said they would be seeking an Attorney General’s opinion.

“On 06/06/2011 an investigator, with the City of West University Place Police Department was made aware of suspicious activity, which may be occurring in the 6200 block of Edloe. The investigator read an email, which was released to multiple West University citizens regarding, individuals possible soliciting drugs to minors at Matthews Market. The investigator will be conducting an investigation into the allegations of drug solicitation at Matthews Market.”
